Your use of this site and the information available on this site is subject to the
following terms and conditions:
1. Terms of use
1.1 The following terms govern your use of the Australian New Zealand Clinical Trials
Registry website, located at www.ANZCTR.org.au (Website). The Website is owned and
operated by the University of Sydney, through its NHMRC Clinical Trials Centre (ANZCTR).
1.2 Your continued use of the Website is conditional on, and will constitute, your
acceptance of these terms, as well as any notices and disclaimers contained elsewhere
on the Website (collectively, Terms).
1.3 ANZCTR may amend the Terms at any time by posting the amended terms on the Website.
Amended terms will be effective immediately and you will be bound by the amended
terms from that time. You should visit the page periodically to review the Terms.
1.4 If you breach any of the Terms, ANZCTR may terminate your right to use and access
the Website.
2. Purpose
2.1 ANZCTR is an online registry of clinical trials being undertaking in Australia,
New Zealand and elsewhere.
2.2 ANZCTR is also a Primary Registry in the World Health Organization (WHO) Registry
Network created by the International Clinical Trials Registry Platform (ICTRP).
This means ANZCTR fulfils certain criteria for content, quality and validity, accessibility,
unique identification, technical capacity and administration.
2.3 As a Primary Registry, ANZCTR will therefore be publicly available and searchable.
ANZCTR may also make arrangements for content on the Website, including text, data,
graphics, images and other materials from registered trials (Materials) to appear
on websites other than the Website (such as the WHO search portal, or other Primary
Registries operated around the world). This will occur by agreement between ANZCTR
and the receiving entity, with appropriate acknowledgement of ANZCTR as the data
source.
3. Registration of trials
3.1 Registration of clinical trials is not legally required in Australia or New
Zealand. To meet the requirements of the International Committee of Medical Journal
Editors (ICMJE) and the WHO for transparency and publication, it is necessary that
clinical trials are registered once on any Primary Registry in the WHO Registry
Network or an ICMJE approved registry before the time of first participant enrolment.
By prospectively registering your trial with the ANZCTR, ClinicalTrials.gov or another
registry approved by the WHO Registry Network or ICMJE, you will be meeting these
requirements. You will only need to register your clinical trial once on one of
the approved registries unless directed otherwise by a local authority (e.g. Human
Research Ethics Committees).
3.2 A person who registers a trial on the Website (Registrant) must be either the
trial’s sponsor or a representative.
3.3 The Registrant is responsible for:
(a) registering the trial;
(b) the accuracy and completeness of registered data, and for indicating when selected
non-mandatory items should be suppressed from public view;
(c) ensuring that information on any one trial is submitted only once;
(d) communicating with trial collaborators regarding the registration status of
the trial, and the registration number; and
(e) ensuring information on the registered trial is kept up-to-date.
3.4 Once a trial has been registered on ANZCTR and publicly displayed on the Website,
the study will remain permanently on ANZCTR database and cannot be deleted, unless
agreed to by ANZCTR.
3.5 Only the Registrant can make amendments to a record.
3.6 If a Registrant wishes to transfer a record to another user, the Registrant
must send an email to [email protected] authorising the transfer. The email should
include:
(a) the request number/registration ID of the record; and
(b) the email address linked to the ANZCTR user account of the person to whom the
record needs to be transferred. If the person does not yet have an ANZCTR user account,
he or she will need to create one.
3.7 After registration, ANZCTR and its staff may send the Registrant(s) reminder
emails to update the study’s information. These updates will be the sole responsibility
of the Registrant(s), who will also be responsible for the accuracy and completeness
of the trial’s data.
3.8 ANZCTR may refuse registration of a submitted trial where the information entered
is not of a sufficient level of English for clear presentation of trial information.
4. Access
4.1 As a user of the Website, you must not:
(a) interfere or attempt to interfere with the proper functioning of the Website
or connect to or use the Website in any way not expressly permitted by these Terms;
(b) use any unauthorised third party software that accesses, intercepts, “mines”,
or otherwise collects information from or through the Website or that is in transit
from or to the Website;
(c) intercept, examine or otherwise observe any proprietary communications protocol
used by the Website;
(d) use, facilitate, create, or maintain any unauthorised connection to the Website,
including without limitation:
(i) any connection to any unauthorised server that emulates, or attempts to emulate
any part of the Website; or
(ii) any connection using programs, tools, or software not expressly approved by
ANZCTR;
(e) reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive
the source code for any software underlying the Website or other intellectual property
used to provide the Website, or to obtain any information from the Website using
any method not expressly permitted by ANZCTR; or
(f) upload or transmit or attempt to upload or transmit, without ANZCTR’s express
permission, any material that acts as a passive or active information collection
or transmission mechanism.
4.2 ANZCTR may change or discontinue any feature of the Website, including the Materials,
hours of availablility and equipment required for access.
4.3 You understand that ANZCTR may for any reason at any time in its sole discretion
and without prior notice to you, prohibit or restrict your access to the Website.
ANZCTR will notify you as soon as possible of any restriction to your access rights.
5. Intellectual property
5.1 The Materials may be subject to intellectual property laws in Australia and
around the world. Unauthorised use of the Materials may breach these laws.
5.2 By registering a trial, the Registrant:
(a) grants ANZCTR royalty-free, non-exclusive, perpetual licence to use the Materials
in accordance with these Terms as amended from time to time, and to sublicense the
use of the Materials on the same terms; and
(b) warrants that she, he or it has all necessary rights to grant such a licence.
5.3 Neither ANZCTR nor any of its contractors, subcontractors or employees make
any warranties, express or implied, with respect to the rights in Materials contained
on the Website. ANZCTR also assumes no liability for any party’s use, or the results
of such use, of any part of the Website or the Materials.
5.4 Some Materials on the Website may be subject to the intellectual property of
third parties. You should consult these entities for any additional terms of use.
5.5 To the extent ANZCTR controls the rights in any Materials on the Website, ANZCTR
permits you to use them on a non-exclusive, royalty-free basis, provided you:
(a) attribute the source of the Materials as ANZCTR;
(b) update the Materials so that they are current at all times;
(c) clearly display the date the Materials were processed by ANZCTR; and
(d) state any modifications made to the content of the Materials, along with a complete
description of the modifications.
5.6 You must not assert ownership or any other proprietary rights regarding the
Materials.
5.7 You must not use any trade marks of ANZCTR or any of its licensors without the
express permission of the relevant trade mark owner. Nothing on the Website should
be interpreted as granting any rights to use or distribute any names, logos or trade
marks, without the express written agreement of ANZCTR or the relevant contributor.
5.8 You must not use any email addresses extracted from our Materials for marketing
or other promotional purposes.
6. Warranties and limitation of liability
6.1 The Website and Materials are provided on an as-is basis and, to the fullest
extent permitted by law, ANZCTR does not warrant that the Website will operate error
free or that the Website and its servers are free of computer viruses or other malware.
6.2 To the fullest extent permitted by law, ANZCTR, its suppliers, or any third
parties mentioned on the Website shall not be liable for any damages, losses, costs
or expenses whatsoever (including, without limitation, consequential loss) resulting
from the use or access of or inability to use and access the Website and the Materials.
6.3 ANZCTR:
(a) makes no warranty (express or implied) in relation to the accuracy, reliability,
timeliness or completeness of the information on the Website; and
(b) disclaims (to the fullest extent permitted by law) all liability for any damages,
losses, costs or expenses resulting from any use of, or reliance on, the Website
or the Materials provided via this Website.
6.4 Reference to any specific commercial product or service does not constitute
or imply ANZCTR’s endorsement or recommendation.
6.5 The Website may contain links to third party websites. ANZCTR is not responsible
for the condition or content of those websites. The links are provided solely for
convenience and do not indicate, expressly or impliedly, any endorsement of the
websites or the products or services provided in them.
7. Termination
The Terms are effective until terminated by ANZCTR. ANZCTR may terminate this agreement
and your right to access the Website at any time with immediate effect. In the event
of termination, you are no longer authorised to access the Website. All restrictions
imposed on you, disclaimers and limitations of liability set out in the Terms will
survive termination.
8. Miscellaneous
8.1 ANZCTR complies with Australian privacy law and the University of Sydney privacy
policy. ANZCTR may make a record of visits and log visits to the Website for statistical
purposes. Such information may include a person’s server address, domain name, IP
address, the date and time of visit, pages accessed, documents downloaded, previous
website visited and the type of browser used. In using the Website, you may be required
to provide certain personal information. This information is needed by ANZCTR in
order to provide the Website, including the provision of information updates. In
particular, if ANZCTR requires you to complete an electronic form on the Website
and in doing so it requires personal information to be entered, ANZCTR will collect
that information to allow it to respond or to otherwise provide the function anticipated
by the electronic form.
8.2 You will comply with all applicable laws in accessing and using the Website.
8.3 If a court of competent jurisdiction rules that any part of the Terms is unenforceable
for any reason, then such ruling will not affect the remaining provisions of the
Terms, which will remain in full force and effect at all times.
8.4 The Terms are governed by and construed in accordance with the laws of New South
Wales, Australia. You irrevocably and unconditionally submit to the non-exclusive
jurisdiction of the courts of New South Wales.
